New regulations that you should be aware of:

Anti-fouling paints are used to coat the bottoms of ships to prevent sea life such as algae and molluscs attaching themselves to the hull – thereby slowing down the ship and increasing fuel consumption.

The International Convention on the Control of Harmful Anti-Fouling Systems on Ships (AFS Convention) currently prohibits the use of harmful Organotins in anti-fouling paints used on ships. The IMO has published amendments to the AFS Convention, which come into force on 1 January 2023.

These amendments introduce new requirements in Resolution MEPC 331 (76) ban the future installation of anti-fouling systems which contain a toxic substance called cybutryne. The amendments also include requirements for ships that already have installed an anti-fouling system containing Cybutryne CAS No. 28159-98-0.

The key amendments include the following requirements:

  • All ships shall not apply or re-apply anti-fouling systems containing cybutryne on or after 1 January 2023.
  • All ships bearing an anti-fouling system that contains cybutryne in the external coating layer of their hulls or external parts or surfaces on 1 January 2023 shall either: Remove the anti-fouling system; or
  • Apply a coating that forms a barrier to this substance leaching from the underlying non-compliant anti-fouling system.
  • The above actions must be implemented at the next scheduled renewal of the anti-fouling system after 1 January 2023, but no later than 60 months following the last application to the ship of an anti-fouling system containing cybutryne.

Yes, all ships should be registered under a flag state in order to travel from on island to another even if the boat is being used as a pleasure craft.

After you have chosen a flag state to register your boat (e.g. Trinidad and Tobago, Grenada, St. Lucia or St. Vincent and the Grenadines) the following are the steps for registration:

  • Formal letter or email should be sent to the chosen flag state Maritime Administration expressing your desire to register your vessel with their administration.
  • The Maritime Administration shall provide application forms for your completion and submission.
  • When forms have been submitted the Maritime Administration will request Tsunami Marine Limited to perform the Registration Surveys.
  • Surveys are performed and reports are submitted by Tsunami Marine Limited to the Maritime Administration and copies are provided to the owners for their records.
  • The Maritime Administration shall provide the owners with a Carving and Marking Note.
  • The owners are to mark their vessel with information provided on the Carving and Marking Note.
  • When completed the Tsunami Marine Limited surveyor shall revisit the vessel to confirm the markings are in conformity with the Carving and Marking Note and endorse the note.
  • The Carving and Marking Note is then submitted to the Maritime Administration, where they will then issue the vessel with its Certificate of Registry and Tonnage Certificate.

Note: Owners should be aware of the peculiar status of vessels registered in Delaware, USA that are operating in the Caribbean.

No, a Condition and Valuation Survey is performed to assess the condition of the vessel for insurance or financial purposes. Whilst the Registration Surveys are performed to confirm the general condition of the vessel, in addition to the confirmation of dimensions and tonnage of the vessel, machinery details and accommodation information for supply to the relevant Maritime Administration (UNCROSS).
